Revisiting the Anti-Defection Law: Balancing Political Stability with Legislative Accountability

Recent constitutional disputes over defections in Maharashtra and Telangana, coupled with repeated Supreme Court scrutiny of the Speaker’s role, have reignited the debate on the effectiveness of India’s Anti-Defection Law. While the Tenth Schedule, introduced through the 52nd Constitutional Amendment Act, 1985, succeeded in promoting political stability, its operation has increasingly raised concerns over legislative autonomy, institutional neutrality and democratic accountability.
How has the Anti-Defection Law strengthened India’s parliamentary democracy?
- Ensures Stability of Elected Governments: The Anti-Defection Law prevents opportunistic floor-crossing, reducing the risk of abrupt government collapse and ensuring continuity in governance and policy implementation.
- Protects the Electoral Mandate: By discouraging post-election shifts in political allegiance, the law preserves the mandate entrusted by voters and prevents its distortion through legislative defections.
- Reinforces the Principle of Responsible Government: Stable legislative support enables the Council of Ministers to function effectively under the doctrine of Collective Responsibility, ensuring executive accountability to the legislature.

Why Has the Existing Anti-Defection Framework Come Under Constitutional Scrutiny?
- Institutional Bias in the Adjudicatory Process: The Speaker, despite performing a quasi-judicial function under the Tenth Schedule, has allegedly remained a political actor, raising concerns over impartiality and institutional credibility. Eg: In Keisham Meghachandra Singh v. Speaker, Manipur Legislative Assembly (2020), the Supreme Court suggested that Parliament reconsider entrusting the Speaker with adjudicatory powers.
- Procedural Accountability: The absence of a constitutional or statutory timeline allows prolonged delays in deciding disqualification petitions, often altering political outcomes before legal scrutiny is completed. Eg: In the Telangana MLA defection case (2025), the Supreme Court directed the Speaker to decide pending petitions within a stipulated timeframe after prolonged inaction.
- Collective Defection: The exception permitting mergers by two-thirds of a legislature party has often legitimised collective defections, undermining the objective of curbing political opportunism. Towards a More Accountable and Deliberative Anti-Defection Framework
- Ensure Independent and Impartial Adjudication: as recommended by the Dinesh Goswami Committee (1990), transfer the power to decide defection petitions from the Speaker to an independent constitutional authority or tribunal to eliminate perceptions of political bias and strengthen institutional credibility.
- Procedural Certainty: During the Telangana defection case (2025), the Supreme Court stressed the need for expeditious disposal of pending petitions.
- Legislative Independence: Limit binding whips to votes affecting the survival of the government—such as Confidence Motions, No-Confidence Motions and Money Bills—while permitting legislators to vote freely on ordinary legislation.
- Institutionalise Inner-Party Democracy: The 255th Law Commission Report (2015) advocated strengthening internal democracy as a prerequisite for meaningful legislative accountability.
- Anti-Circumvention Framework: Review the merger provision under the Tenth Schedule to prevent its misuse for legitimising organised defections that undermine the spirit of the law.

2. Magnetic Levitation (Maglev) train
- Maglev trains operate using levitation, guidance and propulsion generated through magnetic fields.
- Two principal technologies are Electromagnetic Suspension (EMS) and Electrodynamic Suspension (EDS).
- EMS employs electromagnetic attraction, whereas EDS uses repulsive force generated by superconducting magnets.
- EDS generally requires the train to attain minimum speed before stable levitation.
- Propulsion is provided through a Linear Synchronous Motor (LSM) that creates a travelling magnetic field.
- Maglev requires dedicated guideways and cannot operate on conventional railway tracks.
- Absence of wheel–rail contact eliminates rolling friction; aerodynamic drag remains the primary resistance.
- Shanghai Maglev is the world’s first commercial high-speed maglev line, while Japan’s SCMaglev holds the world speed record (603 km/h).
- Superconducting magnets used in EDS exhibit zero electrical resistance below the critical temperature and Meissner Effect.
- Applications include magnetic bearings, MRI systems, flywheel energy storage and semiconductor manufacturing.
3. Qdenga (TAK-003)
- The Drugs Controller General of India (DCGI) has approved Qdenga (TAK-003), developed by Takeda Biopharmaceuticals (Japan), making it India’s first approved dengue vaccine. The vaccine is indicated against all four dengue virus serotypes (DENV-1, DENV-2, DENV-3 and DENV-4) and will be manufactured in India through a partnership with Biological E Ltd., Hyderabad.
- Administered as a 2-dose schedule, with doses given 3 months apart.
- Can be administered irrespective of prior dengue infection; pre-vaccination serological testing is not required.
- India accounts for nearly one-third of the global dengue burden, making universal protection against all serotypes particularly significant.
- Dengue is caused by the Dengue virus (DENV), a Flavivirus belonging to the Flaviviridae
- Transmitted primarily by the female Aedes aegypti mosquito; Aedes albopictus is also a vector.
- Mosquitoes are day-biting, with peak activity during early morning and late afternoon.
- Infection with one serotype provides lifelong immunity to that serotype, but only temporary cross-immunity to the other serotypes.
- Secondary infection with a different serotype increases the risk of Severe Dengue (Dengue Haemorrhagic Fever/Dengue Shock Syndrome) due to Antibody-Dependent Enhancement (ADE).
- Incubation period is generally 4–10 days after the infective mosquito bite.
- There is no specific antiviral treatment; management is primarily supportive.
